How a Florida adoption documents is used in Brazil

When Brazilian parents adopt a child in Florida through a U.S. court, recording the child as their child in Brazil generally requires homologation of the adoption judgment by the Superior Tribunal de Justiça before a cartório or consulate registers it. Intercountry adoptions processed under the Hague Adoption Convention follow different rules, so tell your lawyer which kind yours was. Prepare the Clerk-certified adoption judgment and the child's amended Florida birth certificate signed by the State Registrar, both apostilled and translated by a Brazilian public translator. Adoption files are sealed, so only parties get copies.

Getting a adoption documents Florida will apostille

The final judgment of adoption certified by the Florida Clerk of Court (wet-ink or official e-certification), with all pages attached; its state fee is $20. The new birth certificate must be a certified copy signed by the State Registrar and certified in 2014 or later; its state fee is $10. Both fees are included in our price.

Adoption records are confidential under section 63.162, Florida Statutes, and released only on court order. The easiest time to get certified copies is through your adoption attorney while the case is still open; for an older case, ask the clerk what they require, since you may need to file a request with the court. Who receives it in Brazil — and translation

Cartórios de registro civil transcribe foreign births, marriages and deaths under CNJ Resolution 155/2012, and cartórios de notas use powers of attorney and handle many inventários. Brazilian consulates in the U.S. register births and issue CPF numbers for foreigners abroad. The Superior Tribunal de Justiça homologates foreign judgments, public universities revalidate degrees, the Polícia Federal handles migration, and the Receita Federal and state Juntas Comerciais deal with companies.

Our general rule for translations is certified by the translator, notarized by a separate notary and apostilled in Florida, but Brazil instead requires its own public translators. Under Law 14.195/2021, only a tradutor e intérprete público registered with a Brazilian Junta Comercial gives a translation public faith in Brazil, and the original-language document must accompany it. Apostille in Florida first, then have a Brazilian public translator translate the apostilled original, and ask whether the apostille page must be translated too.

Brazil has no single age limit for foreign documents, but cartórios, banks and registries often want recent certificates, especially certificates of status and criminal records. Order fresh copies shortly before filing; old consular legalizations from before August 2016 are no longer accepted in place of an apostille.

A Florida court adoption generally needs homologation by the STJ before it's registered in Brazil. Bring the Clerk-certified judgment and the amended birth certificate, both apostilled and with sworn translations.
Usually yes, but Florida adoption files are confidential and released only on court order. Call the clerk in the county that granted the adoption and ask what they need.
They prove different things: the judgment proves the adoption, and the birth certificate shows the child's current legal parents. Many foreign registries ask for both, which is $380 for the pair.

Not on the U.S. side — no embassy or consulate legalization. Brazil may still ask for a translation; as a rule it should be certified by the translator, notarized and apostilled too.
