An Italian citizen divorced in Florida needs the divorce registered in Italy, through the consulate and the comune, before a new marriage can be transcribed; the consulate requires earlier marriages and divorces of the Italian spouse to be registered first. In a citizenship-by-descent file, divorces in the line also show up. The Florida document is the final judgment certified by the Clerk of Court, with an original wet-ink certification or the clerk's official e-certification, apostilled and translated into Italian. The state fee for Clerk-certified records is $20, but our price stays the same.
Getting a divorce decree Florida will apostille
A complete copy of the final judgment of dissolution of marriage, certified by the Clerk of Court with an original wet-ink certification or the clerk's official e-certification. The state fee is $20 ($10 apostille + $10 certificate of incumbency), already in our price. If the receiving country accepts the one-page dissolution certificate instead, it must be signed by the State Registrar or a Clerk of the County Court and certified in 2014 or later.
Request a certified copy of the final judgment from the clerk of the county where the divorce was granted, online, by mail or at the courthouse; Florida law sets the clerk's certification fee at $2 plus copy charges, usually $1 per page. The dissolution certificate (divorces from June 6, 1927 on) can be ordered from the Bureau of Vital Statistics or through VitalChek. These fees are not included in our $220.

Who receives it in Italy — and translation
The Consulate General of Italy in Miami handles citizenship by descent and transcription of Florida births, marriages and divorces into the comune's civil records; applicants must live in its district. Citizenship by marriage is filed online with the Ministry of the Interior. Italian notai use powers of attorney and handle property and inheritances, the Agenzia delle Entrate receives inheritance declarations, and universities and CIMEA assess foreign degrees. Since Law 74/2025, citizenship-by-descent applications filed after March 27, 2025 face much narrower eligibility — confirm you qualify before preparing documents.
Italian offices need an official Italian translation of English records, and the Miami consulate states that it does not translate documents. Our general rule is a translation certified by the translator, notarized by a separate Florida notary and apostilled; ask the consulate whether it accepts that format or certifies translations itself. Courts and some comuni in Italy may instead require a translation sworn before an Italian court (asseverata). Translate after the apostille, including the apostille page.
Criminal-record certificates for citizenship by marriage are valid for six months from issue and must still be valid when you file. For descent files, the consulate wants every document in original in one complete submission, so order fresh vital records close to your appointment.
