How a Florida adoption documents is used in Spain

When a Spanish citizen adopts a child in Florida, the adoption is recorded in the Spanish civil registry through the consulate or a registry in Spain. Spanish law on international adoption checks that the foreign adoption has effects equivalent to a Spanish one, essentially a full adoption that ends legal ties with the birth family. The registrar will want the final judgment of adoption certified by the Clerk of Court, apostilled and sworn-translated, plus the child's Florida birth certificate. Florida adoption files are confidential, so request the certified copy through the court.

The final judgment of adoption certified by the Florida Clerk of Court (wet-ink or official e-certification), with all pages attached; its state fee is $20. The new birth certificate must be a certified copy signed by the State Registrar and certified in 2014 or later; its state fee is $10. Both fees are included in our price.

Adoption records are confidential under section 63.162, Florida Statutes, and released only on court order. The easiest time to get certified copies is through your adoption attorney while the case is still open; for an older case, ask the clerk what they require, since you may need to file a request with the court. Clerk and Vital Statistics fees are not included in our $220.

Who receives it in Spain — and translation

The main receivers are the Registro Civil (in Spain, or the Registro Civil Central) for marriages, births and deaths; Spanish notarios for property, powers and inheritances; the Ministry of Justice for nationality files; universities and the education ministry for degree recognition; and Spanish consulates in the U.S. for visas and civil registrations. The Consulate General of Spain in Miami serves Florida.

Our general rule is a translation certified by the translator, notarized by a different notary and apostilled in Florida. Spain may instead require a traducción jurada by a sworn translator appointed by the Ministry of Foreign Affairs, which publishes a searchable list. For nationality files, the Ministry of Justice also accepts translations done or checked at Spanish consulates abroad. Translate after the apostille and include the apostille page.

Spain has no single expiry for apostilled documents; each registry, notario and consulate sets its own, and many treat civil-status certificates and criminal records issued several months earlier as stale. Order fresh certified copies close to your filing date and ask the receiving office how recent they must be.
