How a Florida court records is used in Honduras

Beyond divorces, Florida court records reach Honduras now and then: custody or parenting orders that settle who decides about a child's travel or residence, paternity judgments for an RNP registration, and Florida probate papers when an estate includes Honduran land. A Honduran court or registry will want the full order, certified by the Clerk of Court with a wet-ink or official e-certification, apostilled, and officially translated. Ask your Honduran lawyer whether the order needs recognition by a Honduran court before it has effect there.

Getting a court records Florida will apostille

A complete copy certified by the Florida Clerk of Court, either with an original wet-ink certification and the clerk's seal or with the clerk's official e-certification, including the judge's signature page and with nothing removed or added. The state fee is $20 ($10 apostille + $10 certificate of incumbency), included in our price.

Florida law sets the clerk's certification fee at $2 plus copy charges, usually $1 per page, and some clerks add online fees. Sealed or confidential records need the clerk's release. Who receives it in Honduras — and translation

Births, marriages and deaths are recorded by the Registro Nacional de las Personas (RNP), directly or through a Honduran consulate. Residency applications go to the Secretaría de Estado en los Despachos de Gobernación, Justicia y Descentralización, with a migration-movement certificate from the Instituto Nacional de Migración. Land and estates pass through Honduran notaries, the property registry and the courts. In Florida, Honduras has consulates in Miami and Tampa.

Our standard for a translation is a translator's certification, notarized by a different notary, with its own Florida apostille. Honduras's residency requirements instead call for documents in a foreign language to be officially translated by the Secretaría de Relaciones Exteriores or at Honduran consulates, so a private U.S. translation may be refused. Get the apostille first, then ask the receiving office which translation it accepts.

We could not verify a published age limit for Florida documents in Honduras. Criminal-record certificates for residency are the documents most likely to be checked for freshness, so order them close to filing and ask Gobernación or your apoderado how recent they must be.
