How a Florida divorce decree is used in Honduras
A Florida divorce matters in Honduras when someone wants to remarry there, when the RNP still shows the person as married, or when a residency application needs proof that a prior marriage ended. Use the Florida final judgment of dissolution of marriage, certified by the Clerk of Court with a wet-ink or official e-certification. The one-page dissolution certificate from Vital Statistics is a summary and may not be enough. Ask your Honduran lawyer whether the judgment must be recognized by a Honduran court before the RNP will update the record.
Getting a divorce decree Florida will apostille
A complete copy of the final judgment of dissolution of marriage, certified by the Clerk of Court with an original wet-ink certification or the clerk's official e-certification. The state fee is $20 ($10 apostille + $10 certificate of incumbency), already in our price. If the receiving country accepts the one-page dissolution certificate instead, it must be signed by the State Registrar or a Clerk of the County Court and certified in 2014 or later.
Request a certified copy of the final judgment from the clerk of the county where the divorce was granted, online, by mail or at the courthouse; Florida law sets the clerk's certification fee at $2 plus copy charges, usually $1 per page. The dissolution certificate (divorces from June 6, 1927 on) can be ordered from the Bureau of Vital Statistics or through VitalChek. These fees are not included in our $220.
State fee for this document: $20 — included in our price. Full details on the divorce decree apostille page.
Who receives it in Honduras — and translation
Births, marriages and deaths are recorded by the Registro Nacional de las Personas (RNP), directly or through a Honduran consulate. Residency applications go to the Secretaría de Estado en los Despachos de Gobernación, Justicia y Descentralización, with a migration-movement certificate from the Instituto Nacional de Migración. Land and estates pass through Honduran notaries, the property registry and the courts. In Florida, Honduras has consulates in Miami and Tampa.
Our standard for a translation is a translator's certification, notarized by a different notary, with its own Florida apostille. Honduras's residency requirements instead call for documents in a foreign language to be officially translated by the Secretaría de Relaciones Exteriores or at Honduran consulates, so a private U.S. translation may be refused. Get the apostille first, then ask the receiving office which translation it accepts.
We could not verify a published age limit for Florida documents in Honduras. Criminal-record certificates for residency are the documents most likely to be checked for freshness, so order them close to filing and ask Gobernación or your apoderado how recent they must be.
