Quick answer

The classic India affidavit is a name affidavit: a sworn statement that two spellings, initials or surnames refer to the same person, used for passport and OCI records, bank KYC and property mutation. One Florida apostille is all the U.S. side needs — $220, 5–7 business days.

How a Florida affidavit is used in India

The classic India affidavit is a name affidavit: a sworn statement that two spellings, initials or surnames refer to the same person, used for passport and OCI records, bank KYC and property mutation. Indian records often show a name differently from a Florida birth or marriage certificate, and an affidavit is the standard bridge. Sign it before a Florida notary with a jurat, then apostille it. Use the exact spellings from each record, one per line, so the Indian official can match them without guessing.

Getting a affidavit Florida will apostille

A sworn statement with a complete Florida jurat (“sworn to (or affirmed) and subscribed” before the notary) showing venue, presence or online box, date, your name and ID type, plus the notary's signature and seal. An acknowledgment may still be apostilled, but a foreign office may treat it as unsworn. The statement can be in another language; the certificate must be in English.

Write the statement yourself or use the receiving office's wording; a notary who isn't an attorney can't draft it for you. Swear to it before any Florida notary or through our online notarization add-on: $40 for the first document ($10 notarization fee + $30 technology platform fee) and $20 for each additional document. Notarization is not included in the $220 apostille price.

State fee for this document: $10 — included in our price. Full details on the affidavit apostille page.

Who receives it in India — and translation

The OCI system and the Consulate General of India in Atlanta (which serves Florida) handle OCI and consular matters; sub-registrars and state stamp authorities handle property documents; Indian banks handle KYC and inheritance claims; the Ministry of Corporate Affairs handles company filings; Marriage Officers handle Special Marriage Act weddings; and CARA handles adoptions from India.

Florida documents are in English, which Indian authorities use, so translation is rarely needed. When a document is in another language, our rule applies: a translation certified by the translator, notarized by a different notary and apostilled in Florida. The OCI FAQ asks for an authorized English translation only for certificates not in English.

India has no general expiry for apostilled documents. Specific timing rules apply instead, such as stamping a power of attorney within three months after it first reaches India; banks and courts may also want recently issued copies.

Why affidavits get rejected

  • Acknowledgment used where a sworn statement was required
  • Signed before the notary session instead of in front of the notary
  • Notary related to the signer (spouse, parent or child)
  • Notarized copy of a vital or court record attached as proof

What it costs for India

$220 per document, $380 for two and $160 each for three or more — the state fee, request form, in-person filing in Tallahassee and FedEx shipping inside the U.S. are included. Shipping the finished apostille to India is a flat $100 per order.

Not included: whatever the issuing office charges for the certified copy or certificate, and notarization (online notarization is $40 for the first document — $10 notarization fee + $30 technology platform fee — and $20 for each additional one).

Common questions

Yes, commonly, if it's sworn before a Florida notary with a complete jurat and apostilled. Some offices have their own format, so ask before you sign.
An affidavit carries a jurat: you swore or affirmed its truth before the notary. A letter with an acknowledgment only confirms you signed it, so a foreign office asking for a sworn statement wants the jurat.
No. It confirms the Florida notary's signature and commission. The foreign authority decides how much weight your sworn statement carries.
Yes. Choose international return at checkout: a flat $100 per order, tracked international shipping to any address in India. Shipping inside the U.S. is included.
Not on the U.S. side — no embassy or consulate legalization. India may still ask for a translation; as a rule it should be certified by the translator, notarized and apostilled too.
